China MOFCOM – Rare Earth Export Control (Effective Apr 4, 2025)

• China’s Ministry of Commerce (MOFCOM) has implemented export restrictions on rare earth materials.

• Products containing rare earths — including metals, stainless steel, auto parts, and modules — are now subject to stricter customs inspections (mainly HS codes starting with 70 / 80).

• Depending on inspection results, export declarations may be canceled and re-filed, and unapproved shipments cannot be exported.

For items with rare earth content:
→ Must obtain and submit an “Export Licence for Dual-Use Items and Technologies” issued by MOFCOM.

For items without rare earth content:
→ Customs may still require verification.
→ Shipper should prepare a composition certificate, and for suspicious items (e.g. magnets), request a “Business Reply Letter (业务答复函)” from MOFCOM confirming no rare earth content.

Note:
Each case is handled individually by MOFCOM. Delays or export holds are possible without proper documentation.
